These Terms and Conditions ("T&Cs") govern your use of our website. By accessing our Website you agree that you have read and will abide by the T&Cs as set out below.

1 Website Operator

This website is owned and operated by the Buckinghamshire Family History Society ("the Society"), a charity registered in England and Wales charity registration number 290335.

The Society can be contacted at Buckinghamshire FHS, Box 2 c/o Ace Storage, Unit 7 Broadfields, Aylesbury, Bucks HP19 8BU.

Where used on this page, the terms "Bucks FHS, "BFHS", "we", "us" all refer to the Society.

2 Licence to Use

The Society grants you a non-exclusive licence to use this site under these T&Cs. The Society may terminate the licence at any time. Your continued use of this website indicates your agreement to these T&Cs both current and those in force at any time of future visits which you may make to this website.

3 Registration

While much of this site is accessible to all visitors ("public areas") some material is restricted to members of the Society ("members areas").

Any member of the Society ("member") may apply to have access to the members areas by completing the registration form on the website. The user id and password allocated to members are to be considered confidential and cannot be shared with other people whether members or not.

We may suspend or terminate any user id and/or password or the entire site at any time for any reason.

4 Copyright

This website contains material which is owned by the Society and is protected by intellectual property laws including, but not limited to, copyright law, and cannot be copied or reproduced without prior permission from the Society.

The Society authorises you to view and download material on this site for your personal, non-commercial use only provided that you retain all copyright and other proprietary notices contained in the original material on all copies of the material.

You may not modify any items downloaded from this site in any way or reproduce or publicly display, perform, or distribute or otherwise use them for any public or commercial purpose. For purposes of these terms, any use of these materials on any other website or networked computer environment for any purpose is prohibited. The materials at this site are copyrighted and any unauthorised use of any materials at this site may violate copyright, trademark, and other laws. If you breach any of these terms, your authorisation to use this site automatically terminates and you must immediately destroy any downloaded or printed materials.

You may view, use, download and store the material on this website for personal, research and non-commercial educational use only. Commercial use is not permitted. 5 Contributions to the Site

The Society may make available on the website from time to time a set of forums and other means by which members may contribute to the content of the website.

By submitting to the forums or other parts of the website ("your contribution") you grant the Society a non-exclusive, perpetual licence to publish or reject your contributions on the website and to use, distribute, assign, transfer and/or adapt your contribution for any purpose consistent with the Society's charitable objectives. In this respect you agree to waive all rights that you may have in your contribution including any rights under the Copyright, Designs and Patents Act 1988.

The Society reserves the right to reject or publish your contribution but you are solely responsible for the legality of your contribution and for any claims or liability that may arise in connection with your contribution being posted on the Society's website. In submitting your contribution you are stating that your contribution is your original work and complies with all laws, inter alia, laws relating to intellectual property rights, privacy and defamation. You agree to indemnify the Society for any expense or liability that it may incur as a result of the illegality (or alleged illegality) of any contribution that you submit.

The information given on this site is provided in good faith and is subject to change at any time.

In no circumstances will the Society be liable to you or any other third parties for any loss or damage (whether direct or indirect, including loss of profits, loss of opportunity or any consequential loss) resulting from or in any way connected with your use of the website or its content, whether caused by negligence, misrepresentation, breach of any statutory duty, or breach of contract or otherwise.

9 Legal Jurisdiction

The Society is a charity registered in England and Wales and is based in England. The T&Cs of this website are governed by English law and as such the English Courts have exclusive jurisdiction over the settlement of any claim or dispute which may arise relating to these T&Cs and the use of this website.

1 Under 18s

Children are not eligible to use our services and we ask that minors (under 18 years of age) do not submit any personal information to us.

2 Information We Collect

Our primary goal in collecting personal information from you is to provide you with a smooth, efficient, and personalised experience while using our services. This allows us to provide services and features that most likely meet your needs, and to customise our service to make your experience easier and quicker.

If you are a member of Bucks FHS, to fully utilise this website, you will need to register using the registration form, where you will be required to provide us with your contact information (e.g. e-mail address) and some other information used to identify you. We automatically track certain information based upon your behaviour on our site. We use this information to do internal research on our users' demographics, interests, and behaviour to better understand and serve our users. This information is compiled and analysed on an aggregated basis.

3 Our Use of Your Information

Using the Site's web server log files, we use IP addresses to analyse trends, track users' movement, and gather broad demographic information for aggregate use. IP addresses are not linked to personally identifiable information. This information may include the URL that you just came from (whether this URL is on our site or not), which URL you next go to (whether this URL is on our site or not), what browser and operating system you are using, your IP address etc.

In addition, we use cookies within our site offering features that are only available through the use of a cookie. Cookies are stored on your hard drive, not on our site. Most cookies are "session cookies," meaning that they are automatically deleted at the end of a session. The other type of cookie we use is a 'persistent' cookie. This stays on your hard drive and we may use this cookie so that you do not need to log in manually every time you visit the site if you are a registered user. The cookie itself contains no personally identifiable information but it does pass an ID to our server which allows us to tie the cookie to your personal information. You are always free to decline our cookies if your browser permits, although in that case you will not be able to use certain features on our site. We do not place any cookies on your computer that are designed to be used by any third party. In particular we do not place any cookies on your computer for the purpose of being used for advertising.

Surveys & Contests. From time-to-time our site may request information from users via surveys, contests or for a particular service (e.g. a newsletter). Participation in these surveys or contests is completely voluntary and the user therefore has a choice whether or not to disclose this information. Information requested will include contact information (as supplied to the site during registration) and supplementary information.

4 Our Disclosure of Your Information

Unfortunately, due to the existing regulatory environment, we cannot ensure that all of your private communications and other personally identifiable information will never be disclosed in ways not otherwise described in this Privacy Policy.

By way of example (without limiting the foregoing), we may be forced to disclose information to the government or third parties under certain circumstances, or third parties may unlawfully intercept or access transmissions or private communications. We can (and you authorise us to) disclose any information about you to law enforcement or other government officials as we, in our sole discretion, believe necessary or appropriate, in connection with an investigation of fraud, intellectual property infringements, or other activity that is illegal or may expose us to legal liability.

As a general proposition, we do not sell or rent any personally identifiable information about you to any third party.

Advertisers. We may aggregate personally identifiable information and disclose such information in aggregate to advertisers and for other marketing and promotional purposes. However, in these situations, we do not disclose to these entities any information that could be used to personally identify you.

Bucks FHS Community. Throughout the Site, you are identified by your User ID, which is thereby disclosed to other users and third parties. Your User ID can be used to identify you and your activities throughout the Site. Other people can see your rating, your postings on the Site etc. We also provide a number of ways to allow other users to find more out about you and your site activities if you give them permission to access this information. Please be aware that if you post personal information online that is accessible to the public, you risk receiving unsolicited messages from other parties in return. Bucks FHS cannot be liable for any such communications.

Legal Requests. Bucks FHS cooperates with law enforcement inquiries and other third parties to enforce laws, intellectual property and other rights. Local and international law enforcement agents can request and may receive your personally identifiable information.

5 Discussion Forums

If you choose to post messages in our forums, or leave a message or comment in other areas of the site or leave feedback for us or other users, we will store such information in a file personal to you. This is so that we can see what contributions you have made to the site.

Where you make such comments or forum posts, your User ID will also be given on the site allowing other users to click on it to find out more about you. Although you may choose your own User ID, it is always publicly available information.

We may track which forum messages individual site users read. This is in order to help us understand which content that user is most interested in. We use this intelligence to help personalise the site to match the interests of the user.

6 "Tell a friend" services

Bucks FHS offers a service whereby you can e-mail site content (for example, a particular forum post) to a friend or colleague. This will involve entering the e-mail address of your friend. We do not use the e-mail addresses you enter for any purpose other than to send your e-mail. We do not store, rent or sell these e-mail addresses.

7 Control of Your Password

Except as specifically permitted by this section, you may not disclose your Bucks FHS password to any third parties nor share it with any third parties. If you lose control of your password, you may lose substantial control over your personally identifiable information and may be subject to legally binding actions taken on your behalf. Therefore, if your password has been compromised for any reason, you should immediately change your password by contacting the webmaster.

You can at any time ask to see and have removed any information that we have stored on you, though we reserve the right to charge for this service. Please contact the Webmaster if you would like your personal information removed. We will retain in our files information you have requested to remove in some circumstances, such as to resolve disputes, troubleshoot problems and enforce our User Agreement. Further, such prior information is never completely removed from our databases due to technical constraints and the fact that we back up our systems. Therefore, you should not expect that all of your personally identifiable information will be completely removed from our databases in response to your requests that it be removed.

8 Other Information Collectors

Except as otherwise expressly discussed in this Privacy Policy, this document only addresses the use and disclosure of information we collect from you. To the extent that you disclose your information to other parties, whether they are other members of the Site or other sites throughout the Internet, different rules may apply to their use or disclosure of the personal information you disclose to them and Bucks FHS has no responsibility for the outcome of any such disclosures which you make.

9 Security

On the Bucks FHS site we use best endeavour to safeguard the confidentiality of your personal identifiable information but we do not use encryption (such as SSL) or firewalls to further protect the information as it travels across the Internet. This is because we do not believe that, apart from the credit card information processed by Protx, the personal information we currently collect warrants such measures and the accompanying loss of speed experienced. You should be aware that "perfect security" does not exist on the Internet.

10 Changes to Privacy Policy

If we are going to use your personally identifiable information in a manner different from that stated at the time of collection we will notify you via email, prior to making such changes. You will have a choice as to whether or not we use your information in this different manner. In addition, if we make any material changes in our privacy practices that do not affect user information already stored in our database, we will post a prominent notice, before changes go into affect, on our web site notifying users of the change. In some cases where we post the notice we will also email users, who have opted to receive communications from us, notifying them of the changes in our privacy practices.

Distant Selling Regulations

Goods and services purchased on this site come under The Consumer Protection (Distant Selling) Regulations 2000. This gives rights to the consumer. The Society's policy under the Regulations is as set out below

These are described on various pages on the web site

3 Taxes and VAT
There is no requirement for the Society to register for Value Added Tax and therefore there is no VAT due on any services supplied by the Society. There are no other taxes due. The prices quoted after adding postage and packing is the total price.

4 Delivery and Cost (postage and packing)
Delivery is usually within 7 days of receipt of the order. If we are not able to ship the order within 28 days then we will notify you of the expected delivery date. Costs of Postage and Packing are dependent on the total weight of your order and is added as part of the payment process.

5 Cancelling your order
All orders may be cancelled within 7 days. In the case of good supplied (e.g. books) this is 7 days from the date of receipt by the consumer. In the case of services supplied (e.g. database lookups) this is 7 days from the date of the contract which is the date on which Bucks FHS receives the request.

If you decide to cancel your order, the law requires you to do this in writing. This should be done either by post or email (if available) to the address to which the original order was sent.

On receipt of a cancellation notice (and the returned goods where relevant) the Society is required to refund the cost within 30 days. Cost of postage for the returned goods will be borne by the customer.

Any orders for database searches, magazines or periodicals which the Society may from time to time sell are excluded from the right to cancel.
